1. ACKNOWLEDGMENT OF RISK
I understand that participation in badminton activities at this facility includes, but is not limited to:
Use of courts, equipment, and related facilities
Participation in games, leagues, lessons, clinics, and tournaments
Physical exertion, rapid movements, jumping, and changes in direction
I acknowledge that badminton involves inherent risks including, but not limited to:
Slips, trips, and falls
Collisions with other participants or equipment
Muscle strains, sprains, fractures, or other bodily injuries
Aggravation of pre-existing medical conditions
I voluntarily assume all risks, both known and unknown, associated with participation. I risk bodily injury, including paralysis, dismemberment, disability, and death, and while particular rules of the sport, equipment, and discipline may reduce this risk, this risk of injury does exist, as well as the risk of damage to or loss of property.
2. RELEASE AND WAIVER OF LIABILITY
In consideration of being permitted to use the facility and participate in activities, I hereby release, waive, discharge, and hold harmless:
Cardinal Badminton and Pickleball LLC, its owners, directors, officers, employees, coaches, volunteers, agents, and affiliates
from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while participating in activities at the facility, whether caused by negligence or otherwise, to the fullest extent permitted by law.
3. MEDICAL CONSENT
I certify that I am physically fit and have no medical condition that would prevent my participation. I consent to emergency medical treatment deemed necessary in the event of injury, accident, or illness while on the premises. I understand that I am responsible for any medical expenses incurred.
4. PROPERTY DAMAGE
I agree to be responsible for any damage I cause to facility property, equipment, or other participants’ property due to negligence or intentional misconduct.
5. RULES AND CONDUCT
I agree to follow all posted rules and staff instructions. I understand that failure to comply may result in removal from the premises without refund.
6. MINOR PARTICIPANTS
If the participant is under 18 years of age, I certify that I am the parent or legal guardian and agree to this waiver on behalf of the minor. I assume all risks and agree to indemnify and hold harmless the facility as described above.
I HAVE READ THIS LIABILITY WAIVER AND RELEASE AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS BY SIGNING IT. I SIGN IT FREELY AND VOLUNTARILY.
